Cracks in block walls, doors that no longer close properly, separating finishes, and sloping floors can all point to movement beneath or around a structure.
But identifying the cause is not always straightforward.
The insurance company may attribute the damage to settlement, soil movement, construction conditions, shrink-swell soils, or another excluded cause. In other cases, the issue may be whether the conditions meet the policy’s definition of sinkhole activity or another covered form of ground collapse.
Those distinctions can have major coverage consequences.
We review the policy, the testing, the structural findings, and the insurance company’s conclusions to determine whether the cause of the damage has been properly evaluated.
Common Issues in Sinkhole and Ground Movement Claims
Disputes over the cause of the movement. Settlement, soil conditions, sinkhole activity, construction issues, and other forms of ground movement can produce similar symptoms at the surface. Determining the actual cause often requires more than a visual inspection.
Disagreements over testing. The insurance company may rely on geotechnical testing, structural evaluations, or other expert findings to support its coverage decision. The location, scope, methodology, and interpretation of that testing can become important when the conclusions are disputed.
Policy definition disputes. Terms such as sinkhole activity, settlement, earth movement, and ground collapse may be defined differently by the policy and applicable state law. The precise wording can determine whether a particular condition falls within or outside coverage.
Repair-method disputes. Even when damage is acknowledged, the parties may disagree about what is necessary to stabilize and repair the property. Cosmetic repairs, grouting, underpinning, foundation work, and structural repairs can involve very different scopes and costs.
How We Review a Sinkhole or Ground Movement Claim
We begin with the policy and the evidence used to determine what caused the damage.
That may include structural engineering reports, geotechnical reports, subsurface testing, photographs, repair recommendations, historical property records, and the insurance company’s inspection and testing materials.
When the insurance company has conducted testing, we review what was tested, where testing occurred, what methodology was used, and whether the conclusions are supported by the data.
Where additional technical review is appropriate, we may work with qualified structural engineers, geotechnical professionals, or other experts to evaluate the cause and extent of the movement.
We also review the proposed repair method. The issue is not simply how to cover visible cracks, but whether the recommended work addresses the condition causing the damage and restores the property as required by the applicable coverage.
